1. Acceptance & Policy Suite
By creating or activating an account, using a free trial, purchasing software access or using Market Analytics, you agree to these Terms and the linked Privacy, Refund, Digital Delivery, Cookie and Regulatory policies.
2. Nature of Service
Bhavya AI™ Market Analytics is independent software providing market data, charts, model-based analytics, historical analytics and informational technology features.
- No broker account operation or trade execution by Bhavya AI.
- No holding or management of client trading funds.
- No portfolio-management service.
- No guarantee of profit, return, signal accuracy or market outcome.
3. Eligibility & User Responsibility
The Market Analytics service is intended for adults capable of entering into a contract. Users remain responsible for ensuring that their use of market information and any independent transaction is lawful and appropriate.
4. Account, User ID, Password, PIN & Security
Accounts may use a unique User ID, registered email, password and a 6-digit security PIN. Email OTP, recovery codes and optional two-factor authentication may be used for security.
- Keep passwords, PINs, OTPs and authentication devices confidential.
- Do not share or transfer account access.
- Never send passwords, PINs or OTPs to support staff.
5. Trial, Plans & Software Access
Trial duration, paid-plan duration, features and price are controlled by the live platform configuration. Paid access begins or is extended only after the backend verifies the relevant entitlement and successful payment.
- A paid plan may be purchased as a One-Time Payment or, where expressly offered at checkout, through optional Auto Pay / Auto Renew.
- Auto Pay is never required to purchase an eligible One-Time plan and must be expressly selected and authorised by the user.
- A failed, pending or unverified recurring debit does not by itself extend software access.
6. Pricing, Payments, GST & Tax Invoices
Amounts paid to Bhavya AI Smart Software are for eligible software access/subscriptions or related software services, not trading deposits, investment capital, brokerage margin or client funds.
- The live price, billing period and applicable taxes are displayed before payment or recurring-payment authorisation.
- One-Time Payment remains separate from Auto Pay. Auto Pay is used only where the user explicitly selects and authorises recurring billing through the disclosed payment provider.
- For an Auto Pay mandate, the authorised recurring amount and billing frequency shown at checkout govern that mandate. A material price change will not silently increase an existing mandate; a new or modified authorisation may be required as applicable.
- Online payments and recurring-payment authentication may be processed by Razorpay or another disclosed regulated/payment service provider.
- Applicable issuer, network or payment-provider notifications, including e-mandate pre-debit notifications where required, may be sent before a recurring debit.
- Backend verification and confirmed captured payment control final software entitlement.
- Each successfully verified recurring charge may generate a separate GST/tax invoice and a corresponding access extension.
- Promotional coupons, signup offers or one-time referral benefits do not automatically repeat on future recurring charges unless the specific offer expressly states otherwise.
- Completed payment and invoice records may remain as historical/statutory business records after account closure.
7. Cancellation & Refunds
Refund eligibility is governed by the published Refund & Cancellation Policy, purchase information shown at checkout and applicable law.
Stopping Auto Pay stops future recurring renewals only. It does not automatically refund an already captured charge or cancel an already-paid access period. Where Auto Pay is stopped from My Account, existing paid access normally remains valid until its recorded expiry.
8. Digital Delivery / No Physical Shipping
Market Analytics is a digital software service. No physical product is shipped for normal software access. See the Digital Delivery & Shipping Policy.
9. Analytics, Signals & Market Risk
Charts, signals, scores, scenarios and automated/model outputs are informational and educational analytical outputs, not guarantees.
- Markets can be volatile and losses can occur.
- Past results do not predict future results.
- No minimum accuracy, profit or return is promised.
- Users independently decide whether to undertake any transaction.
10. Referral / Promotional Rewards
Referral codes, promotional benefits or platform rewards are governed by their published program rules and are not trading profit or guaranteed income.
11. Account Closure & Personal-Data Erasure
Users may submit a verified request at /delete-account. The workflow requires account verification, email OTP and administrator review. If an Auto Pay mandate or recurring subscription can still create a future debit, it must first be stopped/revoked and confirmed before final active-account identity erasure can be completed.
- Active name, email, mobile and User ID are anonymised/released from the active account.
- Password, PIN, OTP/reset/activation/session and applicable 2FA credentials are erased or revoked.
- The administrator may erase eligible current profile fields.
- Preserved: GST/tax invoices, completed payments, trading/signal history, reports, quotes, completed payouts, referral/accounting history and other necessary historical records.
- The old User ObjectId remains as an anonymised historical reference so record linkage is not broken.
- A fresh registration can use the released email/mobile; the same User ID can be used again if available. Old history is not automatically attached to a new account.
12. Cookies, Browser Storage & Consent
Necessary browser storage supports login/session security, checkout continuity and core operation. Preference storage may remember settings. Optional analytics/marketing categories are controlled through Cookie Settings where used. See Cookie Policy.
13. Third-Party Services
Payment processing, market data, charts, email, hosting, fonts/CDN resources or infrastructure may depend on third parties and their own terms/privacy practices.
14. Prohibited Use
- Unauthorised access, hacking, abuse or disruption.
- Fraud, impersonation or unlawful activity.
- Materially disruptive scraping/excessive requests.
- Unauthorised redistribution of paid/private access.
15. Availability & Changes
Features, plans, interfaces and technical infrastructure may be maintained or modified. Temporary downtime can occur.
16. Suspension / Termination
Access may be restricted for security, fraud investigation, misuse, non-payment, Terms enforcement or legal compliance.
17. Applicable Law & Consumer Rights
These Terms are governed by the laws of India. Nothing here limits mandatory statutory rights. Subject to mandatory jurisdiction requirements, disputes may be brought before competent courts/authorities having jurisdiction in Jaipur, Rajasthan.
